By accessing or using the website located at www.sparksinsulation.com (the "Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use the Site. Sparks Insulation reserves the right to update these Terms at any time without prior notice. Continued use of the Site after any changes constitutes your acceptance of the revised Terms.
Sparks Insulation is a licensed insulation contractor based in Sparks, NV. We provide residential and commercial insulation services throughout northwestern Nevada and northeastern California. Our contractor license is issued by the Nevada State Contractors Board under classification C-2 (Insulation and Acoustical Contractor). These Terms govern your use of our Site and any service agreements entered into between you and Sparks Insulation.
You agree to use the Site only for lawful purposes. You must not:
Sparks Insulation reserves the right to restrict or terminate your access to the Site if you violate these Terms.
Any estimate provided by Sparks Insulation is provided in writing and is valid for 30 days from the date of issuance unless otherwise noted. An estimate does not constitute a binding contract until a written service agreement is signed by an authorized representative of Sparks Insulation and the customer.
Service work is governed by the signed written agreement, which will include scope of work, materials to be used, pricing, payment schedule, and any applicable warranties. These Terms are supplemental to, not a replacement for, any such written agreement. In the event of a conflict between these Terms and a signed service agreement, the terms of the signed service agreement will control.
Sparks Insulation reserves the right to decline any project request at our discretion.
Payment terms are established in the written service agreement for each project. Unless otherwise agreed in writing, a deposit may be required before work begins, with the remaining balance due upon completion of work. Past-due invoices may be subject to interest charges at the maximum rate permitted under Nevada law. The customer is responsible for any collection costs, including reasonable attorney fees, incurred by Sparks Insulation in recovering amounts owed.
Sparks Insulation warrants that all work will be performed in a workmanlike manner consistent with industry standards applicable to insulation contractors in Nevada. Specific warranty terms, durations, and exclusions will be stated in the written service agreement.
Manufacturer warranties on materials installed by Sparks Insulation are passed through to the customer to the extent permitted by the manufacturer. Sparks Insulation makes no representation that manufacturer warranties will be honored by the manufacturer and accepts no liability for manufacturer warranty claims.
All content on the Site, including text, images, logos, and design elements, is the property of Sparks Insulation or its content licensors and is protected by applicable copyright and trademark law. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our express written consent.
Except as expressly provided in a written service agreement, the Site and all information on it are provided "as is" and "as available" without warranties of any kind, either express or implied. Sparks Insulation does not warrant that the Site will be available without interruption, that it will be error-free, or that any information on the Site is accurate, complete, or current. Use of the Site is at your sole risk.
To the fullest extent permitted by applicable law, Sparks Insulation shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or our services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or related to the Site or our services shall not exceed the amount paid by you to Sparks Insulation for the specific service giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full.
You agree to indemnify, defend, and hold harmless Sparks Insulation and its officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from your use of the Site, your violation of these Terms, or your violation of any applicable law or third-party right.
The Site may contain links to third-party websites. These links are provided for convenience only and do not constitute an endorsement of those sites or their contents. Sparks Insulation has no control over third-party sites and accepts no responsibility for their content, privacy practices, or terms of use. Accessing any third-party site from a link on this Site is at your own risk.
These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Site that cannot be resolved informally shall be subject to binding arbitration in Washoe County, Nevada under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent harm pending the resolution of arbitration.
You waive any right to participate in a class action lawsuit or class-wide arbitration against Sparks Insulation in connection with any claim arising out of or related to these Terms.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from the remaining Terms and will not affect the validity and enforceability of the remaining provisions.
